On April 1, 2024, Germany enacted the Cannabis Act (Cannabisgesetz, CanG), making it one of the most progressive cannabis reform laws in Europe. Here’s everything you need to know as a Berlin resident or visitor.
What Is Now Legal?
- ✅ Adults (18+) can possess up to 25 grams of cannabis in public
- ✅ Adults (18+) can store up to 50 grams at home
- ✅ Growing up to 3 living cannabis plants per adult at home is permitted
- ✅ Cannabis Social Clubs (CSC) are regulated and can supply members
What Remains Illegal?
- ❌ Possessing more than 25g in public (criminal offense)
- ❌ Selling cannabis (unless via licensed CSC)
- ❌ Consuming cannabis within 100m of schools, playgrounds, sports facilities
- ❌ Consuming cannabis near persons under 18
- ❌ Driving under the influence of cannabis
Consumption Rules in Berlin
In Berlin, you can consume cannabis in most public outdoor areas, but must maintain a 100-meter distance from protected zones. Always be mindful of others around you — especially families and children.
Penalties for Violations
Possession of 25–60g in public may result in a fine rather than criminal prosecution in some cases, but this varies by jurisdiction. Above 60g is considered intent to distribute and remains a serious offense.
